Drug offences in Queensland mainly fall under the Drugs Misuse Act, Drugs Misuse Regulation and the Criminal Code Queensland. In the main, the legislation deals with offences involving illegal dangerous drugs (such as heroin, cocaine and the like) and synthetic drugs.
It is also an offence to possess, supply or otherwise deal with a prescription or therapeutic medicine without the proper authority. These regulatory offences involving prescription/therapeutic medication fall under the Health Regulation (Qld).
Certain health professionals, such as doctors, nurses, pharmacists and paramedics have specific obligations to properly prescribe and/or administer therapeutic medication. Failure to adhere to these obligations can have serious criminal or professional regulation consequences.
